If you die without a will this is called dying intestate and state law will dictate how your estate will be handled and distributed; your estate will still need to go through the probate process. Idaho Code provides a method for priority appointment of a personal representative or executor of your estate and dictates who will inherit your property at death. If you die with property in a state other than Idaho, that state’s laws will control the disposition of those assets under their probate laws. It is very important to have an estate plan so you determine where your assets go and not the state of Idaho.
